Terms of Use — Dwoje

1. Agreement

By downloading, installing, or using Dwoje ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Krukit ("we", "us", "our").

2. Service Description

Dwoje is a couples communication app that provides interactive features including polls, temperature check-ins, relationship milestones, pings, planning lists, and game modes (36 Questions, Swipe, Truth or Fiction). The App is designed for couples who are 17 years of age or older.

3. Eligibility

You must be at least 17 years old to use Dwoje.
You must provide accurate information when creating an account.
You are responsible for maintaining the security of your account credentials.

4. Account & Couple Connection

To use Dwoje, you create an account and connect with one partner using an invite code. Each account can be linked to one partner at a time. You are responsible for all activity that occurs under your account.

Content you create (polls, answers, game responses) is visible to your connected partner. By using the App, you consent to sharing this content with your partner.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Harass, abuse, or harm another person through the App
Create false or misleading content
Attempt to gain unauthorized access to other users' accounts
Reverse-engineer, decompile, or disassemble the App
Use automated tools to access or interact with the App
Interfere with or disrupt the App's infrastructure

We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content

You retain ownership of content you create in the App (poll questions, answers, messages, game responses). By using the App, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the service.

We do not monitor, review, or moderate user content between partners. You are responsible for the content you share.

7. Subscriptions & Payments

Dwoje offers a free tier with basic features and a premium subscription ("Dwoje Premium") that unlocks additional features.

Subscriptions are billed through Apple's App Store and managed by Apple.
Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
You can manage or cancel subscriptions in your iPhone Settings > Apple ID > Subscriptions.
Refunds are handled by Apple per their refund policy.
Free tier limitations (e.g., nudge limits, game restrictions) may change as the App evolves.

8. Intellectual Property

The App, including its design, code, game content (36 Questions adaptations, Swipe cards, Truth or Fiction mechanics), branding, and documentation, is owned by Krukit and protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of the App without our written consent.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Availability & Changes

We strive to keep the App available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Dwoje is not a substitute for professional relationship counselling, therapy, or medical advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Krukit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App.

13. Account Termination

You may delete your account at any time from the App's Settings screen. Account deletion permanently removes all your data as described in our Privacy Policy.

We may terminate or suspend your account if you violate these Terms, with or without prior notice.

14. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in the courts of Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or update the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
